These Terms of Use ("Terms") govern your access to and use of the mobile game Neon Paddle Quest (the "Game"), published by AVTR Apps ("we", "us", "our"). By downloading, installing or playing the Game, you agree to these Terms. If you do not agree, please do not use the Game.
1. License to use the Game
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Game for your personal, non-commercial entertainment on a device that you own or control. This license does not grant you any ownership of the Game or its content.
2. Acceptable use
When using the Game, you agree not to:
- Copy, modify, decompile, reverse-engineer, or create derivative works of the Game, except where permitted by law;
- Distribute, sell, rent, lease, or sublicense the Game or any part of it;
- Remove or alter any copyright, trademark, or other proprietary notices;
- Use any cheats, automation tools, exploits, or unauthorized third-party software to interfere with the Game;
- Use the Game in any way that violates applicable laws or the policies of the app store you downloaded it from.
3. Intellectual property
The Game, including its name, artwork, characters, music, sound effects, code and design, is owned by AVTR Apps and is protected by copyright, trademark and other intellectual property laws. All rights not expressly granted to you under these Terms are reserved.
4. In-game progress and data
Your high score, level progress and preferences are stored locally on your device. We are not responsible for loss of progress resulting from uninstalling the Game, clearing app data, switching devices, or device failure. See our Privacy Policy for details on what information is stored and how.
5. Advertising
The Game may display advertising served by third-party advertising networks. We are not responsible for the content of third-party advertisements. Your interaction with such ads is subject to the terms and privacy policies of the relevant advertising providers.
6. Updates and availability
We may update, modify, suspend or discontinue the Game (or any part of it) at any time, with or without notice. We do not guarantee that the Game will always be available, error-free, or compatible with every device.
7. Disclaimer of warranties
The Game is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, secure, or free of errors or defects.
8. Limitation of liability
To the fullest extent permitted by law, AVTR Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the Game, even if advised of the possibility of such damages.
9. Termination
We may suspend or terminate your access to the Game at any time if you violate these Terms. You may stop using the Game at any time by uninstalling it from your device.
10. Changes to these Terms
We may revise these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Continuing to use the Game after changes are posted constitutes your acceptance of the revised Terms.
